| Marker International (NASDAQ:MRKR) announced Wednesday that the Superior
Court of California for the County of Santa Barbara has granted Sims Snowboards
a request for a preliminary injunction against Marker's 80 percent owned
subsidiary, DNR Sportsystem Ltd. ("DNR").
The Court ruling which was issued yesterday would serve to temporarily prevent DNR from distributing snowboard products outside the United States with the "SIMS(R)" mark, pending the outcome of certain arbitration proceedings which have been initiated to determine, among other things, the enforceability of the current Licence Agreement between DNR and Tom Sims. DNR intends to appeal the ruling. Under the current ruling DNR will not be prevented from continuing to grow its business and product offerings under its other brand names "Santa Cruz(R)" and "DNR(R)". Sims had also sought to enjoin DNR from selling its Soft Boot Interface System. However, this request was not granted by the Superior Court and DNR is, therefore, free to market the Interface System immediately throughout the world under the "Santa Cruz(R)" and other brand names.
